Section 17
Power of Police Officers to Arrest without Warrant
Police officers may arrest without warrant in any public place the following persons:
(a) a person knowing that he has committed or is about to commit an offense punishable by imprisonment for 3 years or more by law,
(b) Offenders declared fugitives to be apprehended,
(c) A person who is suspiciously loitering during curfew,
(d) A person who, without reasonable cause, carries a weapon or a tool for breaking into a house at night,
(e) A person who escapes or attempts to escape from a place of detention according to law,
(f) A person suspected of deserting the Nepal Army or Police Force,
(G) A person who has a reasonable suspicion that he has committed a crime as written in paragraph (6) of this Act.
(2) The person arrested as written in sub-section (1) above should be brought to the court as soon as possible within 24 hours, except for the period of manasib mafiq of Bata.
(3) If any movable or immovable public property is about to be damaged, the police officer can prevent the damage in advance.
